Why This Law
In 2015, an apartment building balcony in Berkley, collapsed due to poor construction and deterioration caused by water damage and dry rot and resulted in the tragic loss of 6 lives and injury to 7 others.
As a result, two bills in September of 2019 (SB-721 for apartment buildings) and in August of 2020 (SB-326 for condominiums), known as “Deck and Balcony Inspection” were passed in California
What Buildings are Impacted
All multi-unit residential buildings with three or more dwelling units with exterior elevated elements such as decks, balconies, elevated entry structures and stairways made of wood or supported by wood products, over six feet above ground level and extend from exterior walls of the building.
What needs to be inspected
Inspection of “Exterior elevated element” (EEE) including their supports, railings and their associated waterproofing elements minimum 6’ above ground and extending from the exterior wall of the building.

Deadline for first inspection
January 1st, 2025 *
*Re-inspection every: 6 years for apartment buildings 9 years for Condominiums
